When you are submitting, reviewing, commenting or otherwise interacting with ideas or accessing ideas on the Ideas Challenge, please ensure that you:
The innovationXchange reserves the right to moderate comments and may remove any comments that, in the innovationXchange’s opinion, are inappropriate.
Idea(s) means any document, material, content, text, diagrams or illustrations submitted as an entry or comment to the Ideas Challenge;
Ideas Challenge means the ideas sharing platform maintained by DFAT and known as the Ideas Challenge;
Implementation means the confirmation by DFAT that it will act on and implement an Idea;
Intellectual Property means any trade marks, copyright, designs, rights in computer software, databases and lists, rights in any inventions, technology, experimental methods and results, processes, systems, concepts, protocols, techniques and know–how of any nature, patents, plant variety rights, and all other intellectual property, as that term is generally understood, whether registered or unregistered;
You means the person submitting, reviewing, commenting or otherwise interacting with ideas or accessing ideas on the Ideas Challenge.
DFAT acknowledges that You may submit Ideas which are your own to the Ideas Challenge and You may submit Ideas which belong to someone else to the Ideas Challenge.
In order that You and DFAT understand your rights in relation to the Ideas submitted to the Ideas Challenge, You agree that:
1. all Ideas submitted to the Ideas Challenge which are your own will be acknowledged by You as being your own idea, and you acknowledge that the Ideas:
– are original and originally created by You;
– have not been disclosed in detail to any person outside DFAT other than under a formal arrangement of confidentiality;
– are accurate; and
– do not violate and will not violate the rights of any third party.
2. all Intellectual Property in Ideas submitted to the Ideas Challenge, which are your own, are assigned by You to DFAT on submission and are thereafter owned by DFAT. DFAT agrees that it will consider providing a licence of the Intellectual Property to You in Ideas submitted by You should You request.
3. where You submit Ideas which are not your own, You will attribute the source or owner of the Ideas to the fullest extent possible (for example, where You submit Ideas which You may have seen implemented elsewhere, You will provide full particulars of the source of the Idea including where and when You saw the Idea and any other details of which You are aware regarding the implementer of the Idea).
4. DFAT may rely on your acknowledgement in relation to any claims, demands or challenges made by third parties or by You.
Intellectual Property in an Idea assigned to DFAT by You pursuant to this acknowledgement will be reassigned to You in the event the Idea does not reach implementation.

You agree that the Ideas are confidential in nature. The Ideas may be shared within DFAT, however, You agree that you will not disclose the Ideas or any confidential information outside DFAT.
We will use the personal information You provide in order to gather information on usage of the platform and to allocate prizes to winning ideas and Divisions and/or posts. We will not disclose your personal information outside the Department of Foreign Affairs and Trade, unless allowed by law.
